State Cannabis Programs for Veterans — All 50 States + DC

Every U.S. state has a different approach to medical and recreational cannabis. This guide focuses on what matters specifically to veterans: PTSD qualification, fee waivers, VA records acceptance, employment protections, and the federal installation context that often overrides state law.

Federal employment at military installations and federal contractor positions remains subject to federal rules in every state, regardless of state legalization.

Most Veteran-Friendly Provisions, by Type

Free Patient Registration

The following states waive the patient registration fee for all medical cannabis patients (not just veterans):

  • Connecticut — $0 fee, comprehensive medical program
  • New Mexico — $0 fee, first state to add PTSD as qualifying condition
  • Maryland — $0 fee, broad physician discretion
  • Minnesota — $0 fee, strong DATWA worker protections
  • Ohio — $0 fee, recreational since 2023
  • Texas — $0 fee, but THC capped at 1% (highly restrictive)

VA Records Accepted (Most Vet-Friendly)

One state uniquely accepts VA medical records in lieu of physician certification:

  • Illinois — Veterans receiving VA care can submit 12 months of VA medical records in lieu of physician certification. No other state offers this.

Lowest Patient Registration Fees

  • Washington — $1 patient authorization
  • Montana — $5
  • New Jersey — $10 (waived for veterans with VA disability)
  • Utah — $15
  • Missouri — $25
  • Kentucky — $25
  • Oregon — $20 reduced fee for veterans

Strongest Worker Protections

  • New Jersey CREAMMA — No categorical safety-sensitive exemption; adverse action requires both positive test AND certified Workplace Impairment Recognition Expert evaluation
  • New York MRTA — Prohibits discrimination for legal off-hours use; drug testing for marijuana generally not permissible
  • California AB 2188 — Prohibits discrimination based on off-duty use or nonpsychoactive metabolites
  • Minnesota DATWA — Limits employer testing, requires rehabilitation in lieu of termination
  • Rhode Island — Prohibits discipline for "private, lawful use of cannabis outside the workplace"

Federal Installation Reality — State Law Does Not Apply

Every state with a major military installation has the same caveat: federal facilities operate under federal rules, regardless of state cannabis legalization. Cannabis is prohibited on every installation, and active-duty servicemembers, federal civilians, and federal contractors at these installations remain subject to federal drug testing.

This list is incomplete — nearly every state has at least one significant federal installation:
